1. Acceptance

By accessing or using any of Synapse Mental Wellbeing's services or website, you agree to be bound by these Terms and Conditions. If you do not agree, please refrain from using our services.

2. Privacy

Synapse Mental Wellbeing is committed to protecting your privacy. Please refer to our Privacy Policy for details on how we collect, use, and protect your personal information.

3. Content Disclaimer (No Medical Advice)

The content provided on the Synapse Mental Wellbeing website, including blogs, resources, graphics, and interactive tools, is for informational and educational purposes only. It is not intended to be a substitute for professional medical advice, diagnosis, or treatment.

  • No Therapeutic Relationship: Visiting this website, the mobile application or utilizing its free resources, including free assessments, screener tools, and any other mental health resources, does not establish a therapist-client, doctor-patient, or any form of therapeutic relationship.

    • Such a relationship is only established upon the signing of our Informed Consent Agreement (digitally by clicking on the "I agree" checkbox or physically) and the commencement of formal therapy sessions or a psychiatric consultation.

  • Reliance: Reliance on any information provided by Synapse Mental Wellbeing is solely at your own risk.

3A. The Synapse Mobile Application

License Grant. Subject to your compliance with these Terms, Synapse Mental Wellbeing grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Synapse mobile app on a personal device that you own or control, solely for your own personal, non-commercial use.

App Content Disclaimer. The self-care tools and resources available within the Synapse mobile app — including, but not limited to, the Guided Breathing Pacer, Habit Tracker, and Reflective Journal, and any additional tools or resources we may add to the app from time to time — are provided for informational, self-reflection, and general wellness purposes only. These tools:

  • Are not reviewed, monitored, or read by your therapist, psychiatrist, or any Synapse Mental Wellbeing staff member unless you independently choose to share their content with them.

  • Do not constitute therapy, clinical assessment, or professional mental health treatment, and are not a substitute for the services described in Section 3 above.

  • Should not be relied upon in a mental health emergency. Please refer to the Disclaimer and crisis resources provided elsewhere on our website and within the app.

No Clinical Relationship. Downloading, installing, or using the Synapse mobile app, or any of its features or resources (including booking, the Guided Breathing Pacer, Habit Tracker, Reflective Journal, or any other feature or resource we may add to the app over time), does not by itself establish a therapist-client or doctor-patient relationship. As set out in Section 3 above, such a relationship is only established upon the signing of our Informed Consent Agreement and the commencement of formal therapy sessions or a psychiatric consultation.

Local Data and Data Loss. Content you create within the app's offline self-care tools is stored only on your device, as described in our Privacy Policy. Synapse Mental Wellbeing does not retain a copy of this content and is not responsible or liable for any loss of this data resulting from app deletion, device loss, device damage, operating system updates, or any other technical failure. You are solely responsible for backing up any content you wish to preserve, including through your device's own backup features where available.

App Store Terms. Your use of the Synapse mobile app is also subject to the applicable usage terms of the app store from which you downloaded it (the Apple App Store or Google Play Store), which are incorporated into these Terms by reference. In the event of a conflict between this section and the applicable app store's terms, the app store's terms shall govern solely with respect to your relationship with that app store.

4. Confidentiality

Your therapist at Synapse Mental Wellbeing is bound by professional ethics codes to maintain the confidentiality of your personal information, except as required by law or in cases of imminent harm. Please refer to our Informed Consent Agreements and Privacy Policy for more details.

5. Service Agreement

Your engagement with Synapse Mental Wellbeing is governed by the Informed Consent for Therapy Agreement, which outlines the terms and conditions of our therapeutic relationship.

6. Fees and Payments

Fees for our services will be communicated to you in advance. Payment is typically due at the beginning of each session. Please refer to our Informed Consent for Therapy Agreement for more details on payment policies.

7. Cancellations and Rescheduling

If you need to cancel or reschedule an appointment, please provide at least 24 hours' notice. Failure to do so may result in a fee. Once services have commenced, no refunds will be provided for any portion of the services rendered. Please see the cancellation policy for more details.  

8. Termination

Either you or Synapse Mental Wellbeing may terminate the therapeutic relationship at any time. Please refer to our Informed Consent for Therapy Agreement for more details on termination.

9. Client Reviews

We value the feedback we receive from our clients, as it helps us to continually improve our services and allows others to make informed decisions. By posting a review of our services publicly, you acknowledge and agree that we may repost this review on our website in the following manner:

  • For transparency, we will indicate the platform where the review was originally posted (e.g., Google Reviews, etc.).

  • To respect your privacy, we will only display your first name.

  • If you wish to remain completely anonymous when we repost your review on our website, please inform us, and we will redact your name entirely.

  • Synapse Mental Wellbeing reserves the absolute right to remove any review or content that we deem to be defamatory, offensive, or in violation of these Terms.

10. Limitation of Liability

Synapse Mental Wellbeing is not liable for any indirect, incidental, or consequential damages arising out of your use of our services or these Terms and Conditions.

11. Intellectual Property Rights

All content on this website, including text, graphics, logos, the "Synapse Feelings Wheel," and audio/video material, is the property of Synapse Mental Wellbeing or its content suppliers and is protected by Indian and international copyright laws.

  • Limited License: You may access and use the materials for personal, non-commercial use only. You may not modify, reproduce, or redistribute any content without our prior written consent.

12. Prohibited Use:

You agree not to use the website for any unlawful purpose or any purpose prohibited by these Terms. You agree not to:

  • Harass, abuse, or threaten others via our contact forms or review sections.

  • Attempt to gain unauthorized access to our digital systems (hacking).

  • Use the website in any manner that could damage, disable, or impair our services.

13. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any legal proceedings arising out of or in connection with these Terms and Conditions shall be brought exclusively in Bengaluru, India.  

14. Dispute Resolution

Any dispute arising out of or in connection with these Terms and Conditions shall be resolved through binding arbitration in Bengaluru, India, in accordance with the rules of the Indian Council of Arbitration.  

15. Amendments

Synapse Mental Wellbeing reserves the right to modify these Terms and Conditions or any other policies at any time. Any changes will be effective upon posting on our website. Your continued use of our services after such changes constitutes your acceptance of the modified Terms and Conditions.  

16. Entire Agreement

These Terms and Conditions, together with our Privacy Policy, Informed Consent for Therapy Agreement, Cancellation and Refund Policy, Pro-Bono Policy, "Pay what you can" Program Policy, and any other policy published under the all of our policies page constitute the entire agreement between you and Synapse Mental Wellbeing and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written, relating to the subject matter herein.  

17. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.  

18. Informed Consent

Any services rendered will be subject to acceptance of the informed consent form. Where applicable, the informed consent may include an addendum outlining the terms of the Pro-Bono Policy or the "Pay as much as you can" Program Policy.
